Black Creek Legal PLLC (“we,” “us,” or “our”) operates https://blackcreeklegal.com/ (the “Site,” including all subdomains) and the services made available on it (the “Services”). These Terms and Conditions (the “Terms”) govern your access to and use of the Site and Services, including contact forms, consultation requests, and communications sent through our customer relationship management provider.
PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONSTITUTE A BINDING LEGAL AGREEMENT BETWEEN YOU AND BLACK CREEK LEGAL PLLC. BY ACCESSING OR USING THIS SITE OR THE RELATED SERVICES, YOU UNCONDITIONALLY AGREE TO BE BOUND BY THESE TERMS, INCLUDING ALL EXCLUSIONS AND LIMITATIONS OF LIABILITY, AND WARRANT THAT YOU HAVE FULL AUTHORITY AND CAPACITY, LEGAL AND OTHERWISE, TO USE THE SERVICES. YOU MAY NOT ACCESS OR USE THIS SITE OR THE SERVICES IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS. WE RESERVE THE RIGHT TO PERIODICALLY UPDATE THESE TERMS. 1. No Attorney-Client Relationship
Your use of the Site, submission of a contact form, request for a consultation, or receipt of informational communications does not create an attorney-client relationship between you and Black Creek Legal PLLC, or between you and any attorney, employee, or agent of the firm. An attorney-client relationship is formed only after we have completed a conflicts check, agreed in writing to represent you, and you have accepted the terms of that representation.
Do not send confidential or privileged information through the Site or by email, text, or form submission until we have confirmed in writing that we represent you. Any information you submit before a formal engagement may not be treated as confidential or privileged.
2. Informational Purpose Only
Content on the Site, including articles, practice-area descriptions, attorney biographies, and related materials, is provided for general informational purposes only. It is not legal advice and should not be relied on as a substitute for advice from an attorney licensed in your jurisdiction who has reviewed your specific circumstances. Laws change and facts vary. 3. Eligibility and Acceptable Use

4. Consultations, Forms, and Legal Services
Submitting a consultation request or contact form does not guarantee that we will accept your matter or that an attorney will be available to assist you. We may decline, refer, or discontinue a matter at our discretion, subject to applicable professional-conduct rules and any written engagement agreement.
If we agree to represent you, the scope of services, fees, and other engagement terms will be governed by a separate written agreement. If there is a conflict between these Terms and a signed engagement agreement, the engagement agreement controls for that representation.
5. Communications and SMS
If you provide a phone number through the Site or related intake tools, you consent to receive automated informational and conversational SMS communications from Clio on behalf of Black Creek Legal. Consent is not a condition of receiving legal services. Message and data rates may apply, and message frequency will vary. Reply STOP to unsubscribe. Text HELP for help.
You may also receive emails, phone calls, or other communications related to your inquiry or matter. You are responsible for providing accurate contact information and for any charges from your mobile or internet provider.
Our handling of personal information is described in our Privacy Policy. These Terms should be read together with that policy.
6. Intellectual Property
The Site and its contents, including text, graphics, logos, images, layout, and design, are owned by Black Creek Legal PLLC or our licensors and are protected by copyright, trademark, and other intellectual-property laws. You may view and print materials from the Site for your personal, non-commercial use, provided you do not modify the materials or remove any copyright, trademark, or other proprietary notices.
You may not copy, distribute, display, republish, or create derivative works from Site content for commercial purposes without our prior written permission.

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACK CREEK LEGAL PLLC AND ITS ATTORNEYS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability arising from a formal attorney-client relationship governed by a written engagement agreement and the Idaho Rules of Professional Conduct.
11. Indemnification
You agree to indemnify and hold harmless Black Creek Legal PLLC and its attorneys, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
